Rent claims

Querist : Anonymous (Querist) 16 June 2018 This query is : Resolved
Sir, i am having a civil dispute with my landlord over his false claims of rent that i owe him, the order is ruled in his favour, my lawyer says that i can file a writ in the high court, is this correct?

Ms.Usha Kapoor (Expert) 16 June 2018
Yes! Against trial court order you can file appeal or revision in high court including the against the landlord as landlord as the opposite parties.
Vijay Raj Mahajan (Expert) 16 June 2018
Trail court order can be challenged in higher court in appeal or revision not as Writ in the High Court. Person advising you to file Writ petition against the landlord in the High Court is wrongly doing so. Get some sensible lawyer to help you file appeal against the order of trail court.
