Removal of my mother's name from the joint ownership of my flat

I, Bharathi Mogga, owning a flat in joint Name with my mother. But due to her unfortunate death, I want to remove her name from the joint ownership.

The share certificate has got both the names.

What is the procedure.

produce death certificate and NOC from legal heirs of your mother.. Apply for trf to society to do needful..

make application to society to transfer flat in your name . society will insist on execution of NOC from other legal heirs and require you to execute indemnity bond

All the legal heirs of your mother should agree for the transfer, after getting their consent apply to society.

For: "Venkat Mogga" :

1. Even IF the Society deletes the name of your mother, from the joint membership in the Society records after accepting NOC & Indemnity Bond of yourself and of other legal heirs, EVEN then you will not become the "SOLE" title-owner of the Flat AND you will not be having clear-title of the Flat and hence you will not be able to sell the flat, in future.

Note: Membership of Society is not equal to Title-Ownership in a property.

2. To transfer 100% title-ownership of the Flat, in your name, you will need to apply for "Letter of Administration" with the testamentary division of your State's High Court, after complying with all the documentary formalities etc....
