Remedy

(Querist) 20 August 2014 This query is : Resolved 
Sir/Madam,
A FIR was filed under the sections 498A, 307, 506, r/w 109 Sec 3 of DP act 1961 by my wife's sister-in-law ( wife of elder brother) in the police station on around 10 members. Her husband and farther-in-law were remanded. The other were released on anticipatory bail. Every one know that it was a false case filed only to harass and torture. My wife and myself were included in this case. Please suggest a remedy to get rid of this issue. Also please suggest that

* is there any way to take the revenge on her?
* What will be the future action to be taken?
* Is it necessary to attend the court on taking the bail?

once AB has been granted contest case on merits . vindictiveness dosent pay .

your lawyer can appear on your behalf . yo need not attend on each date

It shall be better to cooperate with the investigating officer. Generally except parents and husband, all other relatives are not included as accused persons in charge-sheet and the accused persons have to defend the case on merits.

You can accordingly initiate your action and once the case is decided, you can definitely take action against that lady but at this stage, try to get rid of the case.

You can move your application seeking exemption for personal appearance only in acute condition otherwise you being accused are required to personally attend the hearings.
