Relieving letter

Hi,

Sub- Relieving letter

I was employee of Microland Ltd. I resigned from that comany and didn't serve the notice period negotiated with my manager but he didn't agree to buyout policy.

They marked me absconding in there record and not provided relieving and experience letter.

Please help.

You have the right to demand a relieving and experience letter.If you have served your notice period or have made payment in-lieu as per the terms & conditions of employment as agreed between you and your employer vide the appointment letter AND also you have settled any dues payable.If you have done all the above and still the employer refuses to provide you such, you can demand that in writing through a registered post. You can serve a legal notice.Moreover you can seek to file a case in Tribunal also.

You have to make payment of your notice period or serve till then after negotiating with the manager otherwise the action of the company is justified.

you have to honour commitments made in your appointment letter . if you want experience letter visit the company and offer to pay for notice period

You have not served the notice period or paid in lieu of the notice period which option was not agreed to by your manager. If the condition of Manager is as per your service condition / appointment letter, you are at fault and the action of company is justified.

If the company is not ready to relieve you by buying out the notice period, you may issue a notice to them demanding the relieving letter in which you can mention that you are ready to comply with the settlement of amount in lieu of the notice period. This notice may be sent by registered post, upon which based on their reply you may choose further legal action against the company in this regard.
