Relieving from company

Hi...I am working with one of leading MNC company which I joined one year back .

However now due to some my personal family issues I need to reallocate myself and I resigned from the company

Since I accepted the offer letter with condition of 3 months notice period which is quite difficult for me to serve considering my family issues

My boss is not relieving me from the services and asking me to serve complete 3 months period which is next to impossible for me inspite of my willingness to pay out the recovery amount.

Moreover I don't want to leave the company with bad relations as world is so small and who knows that I might again get chance to work for this company.

Can anybody please suggest me the procedure for safe and smooth exit from the company

Usually the clause inserted in appointment letter may have option of notice pay in lieu of notice period.....for employer, employee or both....


What is this recovery amount mentioned by you?

It is good to note that you would want to retain the relation in future.
It is two way traffic....

Have heart to heart chat with your line manager, HR head and good offices of appointing authority, MD, CEO etc ...............
If replacement ;in house or fresh/new and/or completion of tasks/projects, on the job training to new replacement is the bone of contention then try what best can be done by you........

Legally you are liable to observe the agreed terms of appointment.

Try to have amicable agreement with the management.

The notice period of 90 days may not necessarily be applicable in your case even if it is inserted by employer in the private agreement/rule/policy/offer letter/appointment letter drafted by it and signed with employee.......

While you remain amiable and gentle try to build irrefutable record of having offered notice pay in lieu of notice period, having completed all tasks, having caused NO loss, having offered to train the replacement, having offered to handover the charge/assets, having offered to suggest replacement etc etc .................


This record shall help you, later if required.

If you can resolve with your own skills while in employment ,nothing like it.

You have already posted that yo can not serve notice period of 90 days.
