Release of FD given as surety

(Querist) 15 February 2019 This query is : Resolved 
Hi All..

I gave a surety in form of FD in a criminal case..now the person is acquitted from the case and i have furnished fresh bail for 6 months as per 437A crpc but the CMM has denied to release the previous FD surety for another 6 month....is he right...if yes how and if no what to do in order to get the FD release asap..

Enclosing the Acquittal Order of Court send or Submit a detailed Letter in CMM's Office and take the acknowledgement marking a copy of your letter to Chief Justice of High Court. You should also mention In CMM's Letter that copy is sent to the CJ also. And it will be done in 30days

If the Court has not directed to hand over FD kept as surety suo moto, submit an application, it would be handed over to the surety if there is nothing against the accused in the case.
