Registered rent agreement

(Querist) 02 December 2016 This query is : Resolved
I want to rent out my commercial land in a town of uttar pradesh to a local person there.

Althought the stamp duty amount is shared 50-50 by landlord and tenant. What i want to know is what is the use of such a agreement. If tomorrow the tenant doesn't vacate my premises , after the completion of agreement and we file a case, what will be the course of action in court.

1. Will they ask me for a reason as to why i want the tenant removed, even though he is paying the rent ? Will they ask me if i actually need this premises more then the tenant ??

2. Will they consider his plea tht his life will be ruined if he leaves this premises as his business is doing well.

3. Will they consider his innumerable pleas, even though we had signed on a REGISTERED agreement that he will leave the premises after the expire of say 2 yrs.

I have seen lakhs of cases pending in courts which are 20-25 yrs old. Will same thing happen in REGISTERED AGREEMENT case also ? Or the court will just look at the agreement and see the things which tenant and landlord had agreed upon and then take up from there.

ALL IN ALL... IS THERE ANY USE OF WRITING ALL THOSE DO' s and DONT's in an agreement

Deepak ji if u do registered rent agreement with proper draft then it will solve all your question.

Do only 11 month leave and license registered rent agreement by paying stamp duty & registration charges.

Will u appreciate this answer by giving like on my LCi prrfile?

The drafting may be entrusted to a very able counsel at your location.

In case a dispute precipitates the properly drafted agreement and facts shall favor you.

1. "IF" the Rent /Lease agreement is duly Stamp Duty paid and duly Registered, THEN in times of dispute with the Tenant, the Courts will entertain and provide relief in the dispute, which would depend solely on the legitimate "DO' s and DONT's clauses in an agreement".

2. "IF" the Rent agreement is "NOT" Stamp Duty paid and NOT Registered, THEN in times of dispute with the Tenant, the Courts will NOT entertain nor provide relief in the dispute.

Terms of agreement would be deciding factor if the case is brought to court.

Properly drafted L& L agreement from your lawyer would serve you in better way in case of dispute.

Law can take care of a person's rights, but cannot answer or secure against all the "IFS" & "BUTS". Please understand that law and its procedures are road maps, not a self-propelling road or the vehicle.
