Registered agricultural land with created will

(Querist) 05 October 2019 This query is : Resolved
I am having ancestral property i.e, my great grand - father's property of A.1.Cents16 with the registered document in the year1932.My Great-Grand Father died in the Year 1934. Because of my grand-father being minor at that time, the property which was not mutated into his name. The property was undivided from the last 3 -Generations. I was born in the year 1996. In the Year of 2008, my long paternal relatives having with the same initial of us registered the land with an unregistered Will to others as the property belongs to their father. We are not residing at the property situated village. With the created will along with the registered documents, the other parties entered into the land registered with revenue records into their names. Now,I have been submitted a Mutation of land application to the Tahasildar. But, the Tahasildar is refusing to mutate my land into my name because of registered deeds submitted by the other parties.

In the above Circumstances, please, kindly advise proceeding against the Cheaters of the land.

You can get copy from registry to prove the illegal documents and file suit along with the legal heirs.

Where is the property located?
It is unbelievable that mutation of your great grandfather (died in the year1934) has not been entered in revenue record, you are misinformed.
It is better to consult a local prudent lawyer with relevant documents/facts for appreciation, guidance and proceeding.

Dear Sir,
The property which is located at Krishan district in Andhrapradesh and my information is true. After the death of my great-grandfather as my grand father's age is 2 years and my Grand-Mother was gone away somewhere else for the torturing of her Aunt. My grandfather was looked after his paternal uncles. There is a big story regards the matter and which is now unbelievable. Moreover, they are Estate holders at that time.

Facts posted are incomplete? Who are the legal heirs of grant-grandfather? Who had executed the Will (it does not matter that the Will is unregistered)? Who, at present, are in occupation of the property?

1. Move the Civil Court, for declaration and setting aside the mutation entries of the Revenue Dept. Do this thru a local property lawyer, which must be supported with all the relevant supporting documentary evidences.

2. Depending on available documents & facts & witnesses, You can file a Police FIR, requesting investigation and charge-sheet, for offences like cheating, intimidation, fraud, breach of trust etc.... against the person/s, supported with all relevant supporting documents.

3. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet. The said Person may come down for settlement.

Keep Smiling .... Hemant Agarwal
