Regarding validity of ikrarnama , please help me

SIR PLEASE TELL ME ABOUT VALIDITY OF THIS IKRARNAMA BEACAUSE IT WAS EXECUTED IN 1971 IN PRESENCE OF TWO WITNESS AND TASDIK BY TEHSILDAR AND REGISTRATION 2001 ACT MANDATES IT TO REGISTER COMPULSORY. BUT IT IS OF 1971 AND MAY IT POSSIBLE TO TRANSFER TITTLE OF PROPERTY THROUGH IT, PLEASE HELP ME

perhaps you are describe about a Muslim family. I do not know the matter of fact of that deed so it is not possible to guide perfectly. It is better for you that contact a local lawyer with documents.

1-Place & subject matter of Property -of Ikararnama !

2-Immovable/Movable Property -Possession delivered-if it is immovable-If it is land-your Possession is recorded in Public Records/Revenue Records

3-1971 Ikararnama /Agreement-1971 applicable law & 2001 /2014 !

4-Why it is made compulsory in 2001 - if not in 1971!

5-The above particulars are required for proper consideration of the matter !

Your Document is of 1971 , the amendment by Act 48 of 2001-Contracts for consideration which have been executed -on and after- commencement of Act 48/2001 - require Registration.

Yes sir , my ikrarnama is of 1971 and amendment was in 2001 for on and after implement of the amendment , so i think my document ikrarnama does not compulsory to be registered , please suggest

I think you want mutations in Municipality and Power connection name change etc - if it is so - contact Local Lawyer and take his advise -whether a Regd Partition Deed / or / a Release Deed between your family unit/You , your brothers & Sisters and Mother - is workable for such mutation etc - and act according to local Lawyer Advise only .

You had already been advised that jurisdiction of civil court is bar as per Municipal Act so first of all make appeal against the order of EO of Municipality before collector and then only file a civil suit if need arises so
