Regarding society agm

Respected Sir,

As I am living in one of the co-op hsg society. AGM of the society held as on 28.09.14. In which following points we observed.

1) Secretary gives a resignation and which is also accepted by the chairman and such thing not informed by committee to the members before AGM.
2) Audited balance signed by the person who is the member of the committee and declared secretary by committee itself and signed the audited balance sheet?
3) Accounts of the committee not accepted by the society members due to non availability of Audit report and several discrepancies in accounts for which committee declear that they get extension for submission of audited balance sheet from registrar and we pass the same in Special general meeting in the ned of next month.
4) Before preparing Audited balance sheet of fy 13-14, no any audited balance sheet prepared for previous year i.e.fy 12-13 by the auditor as this is the first accounting year for the society. society register in jan,13.
5) chairman not acknowledge any letter through which we requested several accounts related details.

Request to give your suggestion on above points of mine and members of the society.

1) when did secretary resign? when was his resignation accepted? if he had resigned recently then society has informed all members in AGM . MC can elect new secretary

2) the audited balance sheet ahs to be signed by Secretary/ Chairman ? treasurer .and circulated to all members 14 days before AGM

3) if any members have any queries in accounts they should inform MC well in advance so that said queries can be answered in AGM . if any discrepancies in accounts auditor should explain the said discrepancies to satisfaction of members
4) society should reply to letters of members requesting clarifications . raise issue in EGM

1. Secretary is one of the members of managing committee of the Society, whose resignation has to be placed before MC and the President (not chairman) alone has no power to accept/reject the resignation of such Secretary. Another member of the MC can be selected (elected, if required) by MC to take on the responsibility of Secretary. The resignation has nothing to do with General Body of the Society.
2. The new incombant (Secretary) shall do all acts of the society, nothing wrong.
3. I agree with the expert advise of Sh. Sudhir Kumar, audited report of the society has to be circulated to all the members 14 days (in Delhi it is 21 days)in advance of AGBM for perusal and approval.
4. Raise your point, in writing and in advance of GBM for clarifications. Ask them in the meeting as well. If still unsatisfied move to RCS.

Sir,
secretary resigned before 1 motnh of AGM. His resignation also accepted with 5 to 10 days from the date of resignation.
Balance sheet signed by both secretary and chairman. Audited balance sheet circulated before 14 days but without auditor report.

society is bound to answer all queries raised by members regarding accounts . only then can audited balance sheet be approved . auditor report has to be circulated to all members
