Regarding experience letter

(Querist) 02 March 2015 This query is : Resolved
Hi All,

I work for an MNC software company. I have completed 6 years of work experience with the same company. In recent past I have submitted resignation in my company not able to bear embarrassment of my manager. As of now I am undergoing notice period time.

Now my manager is troubling me to give smooth reliving from the company. I don't have any email or written proofs of his behavior.

Can you please tell me

1) Is there any way I can approach legally against my manager and my company to get my experience letter and PF account money ?

2) Is there any way for people like me to escape from managers rude behavior ?

3) As of now I am undergoing notice period time. My manger is not giving me sick leaves or casual leaves even though I am eligible under my Organization rules(In my organization everything should be approved by manager and my manager is not giving me approvals)

Could you please help me.

Please approach the higher authorities in your company. If that does not work out, then Please approach the labour court.

----PF: The employer has to supply::: salary slip and salary lip has to show all deductions made from earned wages e.g. PF, ESIC ,TDS etc...:::PF a/c slips of each year:::::PF number

The funds in PF a/c maintained with EPFO are not in control of employer......

Declinature to attest PF forms is an offence. However you should submit PF forms under proper acknowledgment.

It shall be better to transfer the PF and keep a/c regular than to withdraw.

You don't need to submit PF transfer forms to past employer.

2. You can report to :

Rowdiness of bosses is not an unknown thing and there are judgments affirming Rowdiness of Bosses in Office....

3. Leave: At least I am not aware of any law that leave during notice period can be declined.

( Name of the state) Shops and Commercial Establishments Act may state that you are entitled.................implying leave stated in the Act can not be refused....

Model Standing Orders:;The declinature to leave has to be supplied in writing.....

You may preferably proceed under expert advise of an able counsel and let your lawyer draft your communications properly.
