Regarding domestic violence

(Querist) 14 January 2019 This query is : Resolved
Sir, myself working in govt. Sector. My brother do business and stay in other city. He use to do domestic violence on his wife and children. I tried to solve it out with my sister in law with a complaint in police but she is not supporting me. So I want my safety if any tragedy happens between them, please suggest me that what legal procedure I can choose for this situation.

OK.

You tried to help the victim of domestic violence though offender is your brother.

As it happens the victim chose to cooperate with offender instead of cooperating with savior. Nothing new in domestic violence. It happens in most of the cases.

Now for future.

In case she dies natural death within 7 years of marriage then your entire family is booked under section 304B. In this case if you (including your wife and children) are not able to prove innocence (police is not to prove guilt) then you all go for a minimum of 7 years.

So better to dissociate fully.

When your sister-in-law has no complaint against her alleged violence, why do you poke your nose in their personal & private life ? It is between your sister-in-law and her husband, let them carry on their life as they want to go, without having any reservation or interference in their married life.
However, you have no alternative to contest the case(s) when something happen serious. Presently it is your apprehension and law can not be invoked on the basis of apprehension.
No dispute is involved in the present question, you may consult a local prudent lawyer if you feel strong and / or have any other question/ query / apprehension /point.

Sudhir Kumar sir, actually their marriage happened long back, it's in 2004 and I am staying outside since 2006. Is it possible that my sister in law's family go for dowry case now? And how to dissociate with them legally as you have suggested me?

Sudhir Kumar sir, please suggest me above query.
