Reg a property dispute!!

My mother owns a property of 98 cents in kerala, which was till date unknown to her or us till now when we received the will.

by the time we came to know this a builder had already forged some doccuments, constructed villas in this property and also has sold some of them without any of our knowledge or even consulting us..

We dont know what to do to get back the property for which the Original deed/ will doccument lies with us. We have no possession certificate nor any land tax receipts paid as we didnt pay anything and presume that the builder may have paid the same with the forged doccuments.

We have filed a case against the builder in the land tribunal. How do we proceed to prove that the property indeed belongs to my mother and no one else?

Need your suggestions / advices immediately on this.

Why Land Tribunal?
Instead of the Land Tribunal, you should have the Civil Court.

Dear Sir,

Thanx for the reply. We had to go to Land Tribunal, the reason being a Notice that was sent by them to show our rights on the property and asking us as to why a Pattayam cant be issued on this property of land in favour of the builder.

Now we are approaching the civil court for getting a stay Order for stopping the builder from getting a Pattayam for this property as he has forged many of the doccuments of this property.

We would like to know as to how to proceed further for getting the legitimate rights to this property as the original will of the same is with our mother.

Could you pl advise.

Lodge FIR against the builder for forgery. If police does not lodge FIR file direct complaint to the magistrate.

Take stay and file suit for the land.

Consult local lawyer and he would take care of your interests.
