Raising of road level of streets

(Querist) 22 May 2015 This query is : Resolved
Dear Sir,
Plinth of my house is about 6" above the present road level of the street. Municipal Board is planning to rebuilt the road by raising its level by 24'' or more resulting the plinth level of our houses become lower than that of road. Can anybody guide us about the following;
1.If there is any law which governs the road levels in India?
2.Can we prevent local body or other construction agency to raise the level of roads?
3.How can we force them to maintain the level of new road as it was earlier?
Thanks

The decision of the Municipality is for public utility and you can not challenge simply because your house plinth height is lower. This is not so with you but also with other inhabitants in the vicinity.

You should explore the possibility of raising plinth of your building.

Raising your house plinth level little more than adjacent road is the only solution.

No doubt it will not be possible to raise the plinth level of house, but a check can be built to prevent the rain waters into the house will lie below the road level. The Municipal decision is for the public welfare, in that your apathy will be ignore.
