Hi sir, I am a TY.LLB student from Mumbai I need help regarding 79A bye laws what does it says and mhada rule DCR 33(5) information? illustrations- A is staying in a society where 5 buildings of mhada with different society name now society 5,4,3,2, are agreeing for Redevelopment on the plot with 10k sq.ft Shortlisting for PMC Society 1 is against but tenants are interested My question can 1society can stop the redevelopment project?

Honestly since not studied documents I can go wrong but try to explain you
1) MAHADA function under MAHADA ACT , now while alloting flats or tenment under which scheme MAHADA has done or transferred entire building is required to be studied. See they have many schemes and you can not compare one scheme with other. They may have done some deed and one deed with one set of people and another deed with another set of people may be different.
2) After examining papers you need to short list Mahada terms and condition for your land building etc
3) Then you need to analysis Co-operative society act
4) The provision of DC rules under the MRTP Act is a different thing.
So now you are taking entire project advice on this forum which is beyond the capacity without examining proper papers documents etc.
I can only suggest you study the matter or you take professional consultancy in this
If you want to study 1) Purchase MAHADA Act and rules booklet 2) Purchase Co-operative society act and rules 3) Purchase some book on redevelopment of society 4) Purchase book on Development control regulation of Mumbai
All 4 book I think Snow white publication will be better take the latest edition because it contains GR , notification etc.

There are other factors too how one society is legally connected to another society. Technical thing (like architecture point of view) too require study
