Query on partition deed

We are 5 brothers i'm the last. We decided to make a pertition deed of a property in which me and the 4th brother are taking and the first three are taking another property side by. Now my doubt is that in the deed papers it is written that after making the partition deed the original papers will be with the 4th brother i will be having a dublicate one. So is there any deed to make further so that i too can have the original one because i was thinking of taking a home loan for construction.

you may apply for certified copy of the deed it is as good as orignal

Is the partition deed enough to apply for a bank loan or we need to again register separatetly

The partition deed (registered) may be presented for updation in mutation records.

Copy of updated mutation record be obtained.

It is upto lender to accept certified copy in lieu of original copy with or without any hesitation or objection or condition.

If 4th brother is not availing any loan then you can ask to insert your name for retaining the original copy.

You can also ask to insert whenever required the retainer shall bring the original for verification.

You can also make a mention it as a reason in application for certified copy (keep a certified copy of application) and attach copy of the deed while applying for certified copy.

You can also inform the lender in advance that original copy is with ...............and otherwise also the lender shall go for legal opinion about any title document that you produce.
