Purchased land used for 50 years now kin asking land back

(Querist) 16 April 2014 This query is : Resolved
Sirs,

At Tamil Nadu, in our village we have purchased one property 50 years back, where in 1999 we have constructed home by taking bank loan base document is VAO's (Village Administrative Officer) certificate. The land owner is expired in 1982 who is my uncle (i.e., my father's sisters husband). That time they lived as joint family. My father is alive now he is 75 years old. The biggest mistake my father was done is that the land was not registered then purchased time.

In 2012 I have made some payment to uncle's kin for making purchase registration.

Now after taking payment from me,the kins are turned our and informing they would not do the registration, so i went to court filed the case against them, they non of them is resident of our village (local address). Please give proper advice to me.

you have any receipt of amount paid by you against the said property?
who is the actual owner of that property till date? is it a ancestral property?
What are the documents as a resident proof?
it is better to settle the matter amicably if not achieve goal then take shelter of law.

The facts are not sufficient to advise, please consult a local lawyer and show him all the documents.

You mean the summons were not served on them?, then there are other alternatives for this, you can either produce their actual address (which, they being your relative, should be known to you) or request the court for substitute service of summons. Your lawyer will be able to guide you, be in touch with him.

What is the prayer in your case?

What is the current status of your case?
