Magistrate directed police to investigate and file police report u/s 156(3) Crpc in a complaint filed by me to the magistrate in year 2011. Police regd fir in year 2012 and did malafide investigation to protect accused. Now police said they have closed case and magistrate ordered police to file closure report. Now I've to file protest Petition before magistrate. How to file protest Petition and whom should I add as parties in protest Petition.

You cannot file protest petition. You can file private criminal case against the accused

1. File a simple application, "Protest Application" by affixing 5/- court fee, and pray orally to put forward arguments to the Magistrate.

2. Parties remain same, as in your original complaint application.

3. IF magistrate finds substance in oral argument in the protest petition, then your original complaint application will be allowed, irrespective of Police report or whatever and case will be proceeded, in the normal manner.
