Property purchased via partition deed

I have purchased a property in delhi from owner who has ownership to proprty via partition deed. He lives in haryana. When i have given token mny for same he handed over the photocopy of same which has registeration no 11030 .I got it checked thru lawyers preprd the sale deed etc..Registry was done he handed over the original copy of partition deed. Then i discovered the original copy has regstration no 11031...as he must have the additional copy of partition deed. Now my regstry has 11030 no as reference of his ownershp bt original partion deed has 11031.
More facts: no. 11028 was the main partiion deed..and other three brothers got additional copy of deed with no 11029,11030,11031.
Now do my registry is invalid?? Should i ask for replacement to give me 11031 partition deed?

As in my regstry referrence no 11030 is given..bt the original partition deed( additional) i got has reg no 11031.

From your query i understood that before registration of sale deed you had checked the records of concerned registrar and found the partition deed registered.
From your narration it appears that same document is registered on four registration numbers and one of those number is the number mentioned in your sale deed .You are satisfied with the title of vendor.
You may get the number corrected by getting a correction deed executed by the vendor

First you show to Sub-Registrar Office and inquired about , how it happened? first you mentioned that the photocopy of partition deed bears no. 11030 and later you mentioned that orig. partition deed bears no. 11031. How can it be ? And you too got the no.11030. Get it checked through your lawyer.

As the original partition deed was containing no. 11028 which subsequently went on partitioned as no. 11029, 11030 and then 11031 and your vendor has exclusive right of title in 11031 which has not been mentioned in your sale-deed.

Though your vendor has also joint right in registered partition deed no. 11030 which stands sold to you but as he himself had further got partitioned that joint share by way of 11031 hence he is liable to get it corrected in the registered sale-deed as per terms of sale-deed that the seller shall be responsible for the issues of title even if it is disclosed at later stage.

You need to get registered Correction Deed otherwise the possibilities of double sale of the same property by seller on the basis of deed no. 11031 cannot be ruled out.

Don't take this issue lightly and take immediate effect. Have you taken possession of the property and what is the status of name change in the record of MCD?

Yes we have taken the possession. I dont knw if mcd records is to be checked too how to do it. Can i replace 11031 by 11030. As his brother lives there bt owner does not live here he lives in haryana. Further original 11031 is with me...still it can be sold double??

Haryana is not away from Delhi. You might be having the knowledge that Haryana surrounds Delhi from 3 sides. I also belong to Haryana. Don't give impression as if Haryana is a part of USA so its distance is so long that original owner cannot come to Delhi for the correction of sale-deed.

I have given my mind in my previous post. Nothing can be ruled out even if the owner is not having original partition-deed with him.
