Property of female

my aunt has died in accident leaving behind a property, she had two children one is major and other is minor, my uncle wants to get the property in his own name now...what is the procedure and who all wil be considered her legal heirs, how wil the minor son sign the document.

It is believed that your deceased aunt was Hindu. Her ClassI legal heirs are present and share the estate equally i.e. Husband, major son,minor son.

Father is natural guardian of minor son.

Father can not alienate the property share of minor son without permission of court.

You may show all docs on record to an able lawyer specializing in family/property/civil matters and let your lawyer opine on the matter.

Better to take help of lawyer since it brother in law is indulged n minor son is also claiming right
