I AM HAVING AGRICULTURE LAND DISTANCE AT 11KMS FROM GRAMPANCHAYAT /MUNCIPALITY OFFICE AND POPULATION IS 10,000/- WHETHER ON SALE OF AGRICULTURE LAND CAPITAL GAIN TAX ATTRACT OR NOT PL REPLY

The distance is not to be measured from the Municipality Office, but from the t of the Municipal Limit.

Only if the land is situated beyond 2 Km. from the boundary (i.e. the limits) of the Municipality, then the said land would be treated as Agricultural land otherwise not.

In otherwords, if the land is within 2 Kms. distance from the municipality limits then it is not Agricultural land.

On the above basis only if it is an Agricultural then it will not be a 'Capital Asset' and therefore would not attract Capital Gain, otherwise it will attract capital gain.

You can visit local revenue office to find the exact position.

Yes, even where the language is plain and unambiguous, the moment it relates to TAX approach the CA Club. Please realise, it is the lawyers who appear before the HC and SC in the TAX matters and not the Chartered Accountants. The judges sitting in the Court are not always CAs, still they interpret the law and give decisions. They do not approach any CAs before arriving at the decision!

In the Criminal Matters an aggrieved person can invoke the jurisdication of High Court by Appeal or a Revised Petition as the case may be.In the matter of Direct Taxes the Aggrieved Person Can Approach the High Court in Sec 256 of Incometax Act 1961,Sec 26 of Gift Tax Act 1958,Sec 27 of Wealth Tax Act 1957,Sec 130 of Customs Act !962 Etc.An aggrieved person may as well invoke the jurisdication of High Court under Act 226 of the Constitution Complaining Breach of Fundamental Rights or for Any other Purpose.For your Query the Professional CA would be the right Person for a Perfect Reply.

The right of the individual to appear in person is universal and not restricted to criminal matters or only tax matters.

The question here is that the aggrieved person is ignorant and seeks a view to his doubt. How that ignorant person will perform in the Court?

Can you say that the CA Club can give answer without knowing the distance of the land from the Municipal Limit?
