Property dispute query

(Querist) 16 August 2017 This query is : Resolved
Hi ,
One of my co sister lost her husband in 2012. There was a property in his name. which was got transferred to her name after few months from his death. Now His Mother and sisters are filed a case and asking for their share in that property. But his sister is well settled and also she got few properties from her mother ( properties were came from her mothers mother side) but still the case is running in court. Even now My co-sister is got married and so they are saying she is not supposed to get property share only Kid can ask for it. Please clarify these confusion. Is there a way to come out of this and stop his sister not to come for share as she is well settled by collecting money from her brother while he was alive.

If the deceased was Hindu, his property after him would be inherited by his legal heirs ( mother, wife, sons and daughters) if expired intestate.

Inheritance opens on the day of the death of owner.

In the present case the property would be equally inherited by mother, wife, and children of the deceased.

Agreeing with Mr. Rajendra K Goyal......

On strength of which valid/registered deed the property was registered in the name of wife alone?

If mother has signed say: a relinquishment deed then she has NO share now.

Sister has NO share at all, as ClassI legal heirs are present.

During his lifetime first husband transferred some property in your co sistrer's name so she has full rights of ownership over that property even if she is remarried now.She and the her kid through first husband would alone have rights over that property transferred to her in her name during his lifetime.. Your cosisters's sister in law or her first husband's sister doesn't have any rights in your co sister'sproperty transferred in her name by her first husband.

If all involved are Hindu............then mother being Class I legal heir has equal share.............
Kumar Doab (Expert) 17 August 2017
Until or unless, as already posted:

'If mother has signed say: a relinquishment deed then she has NO share now.'

Of course, Sister has NO share at all, as ClassI legal heirs are present.
