Property dispute

(Querist) 28 January 2015 This query is : Resolved 
my client have a plot in delhi. He got it through irrevocable power of attorney but it was neither registered nor witness there. Now, some goons sold this plot to many persons without any consent from my client through fake docs. How can I prove in the court that my client is the only real owner. The seller who have sold it to my client is ready to give his statement into the court that he had sold the property to my client.

Dear Sir,When you say by "fake documents" everything is meant .First advise your Client to Safe guard the Possession.File a Police Complaint regarding the Fraud and Obtain FIR.You could approach the Registrar to cancel the Fake Registration with all the Proofs along with Original Owner the Seller and with required Affidavits and get your Transaction Registered.Also Issue a Public Notice regarding this in News Papers.

you should ask the person who sold property to you to register sale deed in your favour . mere POA is not sufficient to confer legal title to property

Your client as the real owner has the absolute right to proceed against the fraudsters.

Irrevocable POA with out registration is defective document. Real owner should register the property in the name of your client.

The unregistered sale deed or POA will not confer any title to the property in any manner whatsoever. The vendor may be approached to execute the registered sale deed in your clients favor and take up the issue legally.
