(Querist) 25 June 2016 This query is : Resolved
Hi respected lawyers,

My case is pending in Lucknow high court which related to murder of my mother.the last date of hearing was 2nd may 2013 and after that no hearing has been made.so I have few questions around this:
1) Is there any law or procedure that a high court need to follow to decide a next date of hearing of a criminal case?if it is then what is the procedure?
2) who has the authority to put a file in high court for next hearing on a particular date, registrar or judge?ie who decide the date of hearing for a particular case in high court?

3) Is there any way to get early date of hearing in high court. Is there any law or procedure for that?please explain.

Thanks

1. There is no such law. However it appears you lawyer has sat idle and hence the matter was not taken up earlier.
Ask him to mention the matter for listing. It will be heard.
2. Only judge hears a case.
3. Mentioning for listing is only way.

Sir I just want to know some details about this method of listing as I am getting misguided from last 3 years.
How can a lawyer request the mentioning for listing of a case? i.e do he need to approach registrar for getting date of next hearing? can I get any particular date of hearing that suits me?

"My case is pending in Lucknow high court which related to murder of my mother". In such a case State is the complainant. As such, how you are concerned with the case?

1) Cases are taken as per procedure. Ask your lawyer to follow up with the court.

2) Judge is proper authority to hear and decide the case.

3) Discuss with your lawyer.

Hi sir,
I have made appeal in high court in this case as the accused was acquited from lower court.

Did you put all these questions to your lawyer? If so, what is his observation, opinion and guidance?

Are you satisfied with his (your lawyer's) performance, advise and proceedings? If dissatisfied, did you change your lawyer?

However, none of the questions in your query involve legal opinion wherein the experts may give you some suggestion and advise.
