(Querist) 28 July 2016 This query is : Resolved 
I have got contested divorce from my husband 2014 and legal custody of the child (Son) is with me.
My grand father-in-laws purchased a lease-hold property (House) in 1960’s at New Delhi. Since my grand father in law died in 1980’s without leaving any will. Therefore, in 1997 My father-in- law & his brother applied for free hold and & got that property registered in their joint names. Later on in the year 2000 they divided the property equally and executed partition deed which was also registered.

Query:- Now. I have come to know that my father in law has sold that property to one of his son.( i.e. my brother in –law ).
2. Can I file any legal suit to claim for myself and for minor son’s rights on said property.

U can't file any suit to claim any share in said property as now ur divorced. Ur son have share in said property which he can claim after life time of his father/ ur divorced husband.

No, you have no right in the property of your ex-husband; your son, during his lifetime.

It came under definition of self acquired property by your father in law. He has right to bequeath / gift / sell / mortgage it. You or your son has no right to prevent him.

Forget about any procedure. You have already severed your relationship with the family of your husband and his family forfeiting all of your rights, except maintenance, as may be permissible under law, and question of your son's right cannot arise during the life time of his father.
