Power of attorney

(Querist) 29 July 2015 This query is : Resolved
Given power of attorney to someone in 1996. Partially used during that year but could not be cancelled. 4 months back attorney holder went to the office of sub registrar to get sale deed registered using that attorney without giving me the payment for the plot. I requested sub registrar to stop the registration and also gave in writing that this land is mine and other person is trying do get sale deed registered in the name of his son without giving me the payment. The registrar said that as the attorney was not cancelled he can not stop the registration and went ahead with the sale deed. What should i do now. Is there any method to get my payment.

You have to act very fast.
Better approach a local lawyer well versed in property law and to take immediate action - like lodging police complaint (this is has to be properly written for this you require the assistance of the lawyer).

Apart from this, you have another problem of capital gain from income tax point of view on the sale of the plot. Therefore, better act fast.

It is not clear you are located in which place.

Located in nawanshahr district of punjab. We had made a complaint to the deputy commissioner and S. D. M but they said as attorney was not cancelled so the sale deed was valid.

Yes They are Right.Better Go for amicable settlement.Legally the Power holder is strong. You should have initiated the Cancellation of Power Well before all this. When the Registrar advised you that Power is Not Cancelled you should have done it then and there. It is Nothing But Power given by you and No Police Complaints would be entertained and Obviously you would not have mentioned Regarding Money to be Paid to you in that.He could justify him self with so many Valid Legal Reasons.Go For Amicable Settlement. You should have Analysed the Person before Executing the Power to him.
