Possession of flat

Hello Everybody,

My case is filed in civil court for the possession of the flat and still their is no result coming since long time.So can i file my case under consumer court for the possession of my flat.

once you have already moved the courts in this regard you cannot seek same relief in respect of same cause of action from consumer forum . you should have filed in consumer forum at first instance . you save on court fees and results are faster

After filing civil suit the consumer court has no jurisdiction to try the complaint for same relief which has been sought in civil suit.

if a dispute is pending in civil court then no case lies in consumer court anymore.

The case is pending with civil courts, now you can not move to consumer forum for same cause of action. Agree with the expert.
