Petroleum act

(Querist) 27 November 2015 This query is : Resolved
I am running a DC petrol pump in U.P. from 35 years. The land taken on lease and now land owner refused to renew it.Land owner tried to unauthorized controlled over my pump, records and staff and for this reason my supply stopped from 30 days. He (land owner ) blackmailing me that either I have to do partnership with him or he will shut down my petrol pump. He is a rich person and have influence over Indian Oil officials because he has already a petrol pump in same state.
Indian oil official said that "if you will not renew such land lease, you cannot run the pump and Iocl will not allow to transfer your dealership to any other land."
My question is Can Iocl terminate my dealership on aforesaid grounds and only for that particular land, or Can I transfer to my dealership in any other place like Rajasthan?
What is rights, I have against IOCL and land owner in this situation ?

The landowner cannot take Law into his hands. He needs to get a decree of the court to evict you esp. since your have rights and interests in the property.

Have you received any official communication from IOCL?

Rajendra K Goyal (Expert) 28 November 2015
Approach court for a stay on the action of the landlord and to direct IOC to resume supply.

Discuss with your lawyer in detail.
Anirudh (Expert) 28 November 2015
No court can compel any landlord to renew a lease which has expired by efflux of time.

Unless you have permission to be on the land (either by lease or on ownership basis) you will not be able to run the petrol pump from that premises. Therefore IOCL will not give you supply unless you renew your lease.

IOCL will not allow you to transfer your rights to Rajasthan.
