(Querist) 21 April 2014 This query is : Resolved
Sir
I am a govt employee. I have recently completed my graduation without taking permission from my department. Now I want to appear for IAS/PCS examination, Need i obtain noc from my department for appearing in IAS/PCS examinations? what action can they take for the fact that i completed my graduation without informing them? Can they cancel my degree?

You have competed graduation without taking permission of the department.

The department cannot cancel the degree but surely they can refuse to enter in your service record and also refuse to forward any application for any job where graduation is essential qualification.

You have competed graduation without taking permission of the department. e for disciplinary action.
Devajyoti Barman (Expert) 21 April 2014
But you have said in your query that you have completed graduation of taking permission.
Which one is true?
Rajendra K Goyal (Expert) 21 April 2014
There is contradiction in your query whether you received permission for degree from your employer or not.

If you have not taken permission, your degree may not be accepted by employer, disciplinary action can be taken against you, your request to forward your application for employment can be held up,

You should try to get post-facto permission and to enter your qualification in your service sheet.

I have not taken permission. Can they cancel my degree anyway?
VIKAS TANDON (Querist) 22 April 2014
How to apply for post-facto permission? Are they bound to give post-facto permission or it depends upon their will?
What if I dont reveal my credentials as having worked in as a government employee earlier in IAS examination?
VIKAS TANDON (Querist) 22 April 2014
@ devajyoti sir, I haven't taken permission.

Mr. Tandon,

In fact, your query is quite irrelevant. Pemission or no permission, it is a matter of commonsense, how your department is competent to cancel the degree granted a university, which is not under the control of your department? Your department can only take disciplinary action for not taking permission for higher studies, but cannot cancel the degree granted by a university.

Post facto permissions are not granted for the acts which are to be started after due permission of the department.

About permission for appearing in IAS and PCS, that is a must to be taken from your department, as per the conduct rules of your department. You should simply apply for permission to appear in the IAS or PCS exam and wait for the response of the competent authority.

But, I wonder, if you are not able to understand and distinguish between general things like the competence of your department to cancel degree, which that has not granted to you, rules of employee discipline of your own department, etc., how you would be able to fair in the competitive examinations, like IAS/PCS!

Anyway, best of wishes, if you are permitted to take exam of IAS/PCS.

Well advised by Mr.P.S.Dhingra The Query is resolved.Nothing to add more.

Mr. Vikas,

Your Superintendent does not enjoy any power to cancel the degree granted by any university. Degrees are cancelled only if unfair means are adopted in the exam by the examinee, which is beyond his scope to prove.
