(Querist) 09 November 2018 This query is : Resolved
Sir,
I am a central government pensioner in Hyderabad, Telangana State. At the time of retirement, my pay which was fixed as per Pr.Central Administrative Tribunal, New Delhi was reopened and pay was reduced with malafide intensions. Is it tantamount to contempt of court? If so,Can I file contempt of court in Hyderabad CAt.

VVSS Prasad.

Contempt will not arise.Neverthless no recovery could be ordered pointing out wrong fixation. If at all insisted, judgement of Apex court could be cited .

Facts, as stated, are incomplete that no meaningful suggestion is possible.

You can refer the judgement of Supreme Court in Civil Appeal 3351-3354 of 2003 Syed Ahmed Khade Vs State of Bihar

The operative portion of the Supreme court order is
" We direct that no recovery of the excess amount, that has been paid to the teachers of
Secondary Schools, be made, irrespective of the fact whether they have moved this
Court or not. We also direct that the amount that has been recovered from some of
the teachers, after the impugned judgment was passed by the High Court,
irrespective of the fact whether they have moved this Court or not, be refunded to
them within three months from the date of receipt of copy of this judgment."

You can consult the same lawyer who helped you to win the case in Principal Bench, CAT, New Delhi to review and file a case if the action of authority is arbitrary and contrary to CAT judgement without any appeal in Delhi High Court.
