Name of father and 5sons was recorded on 7/12 extract in 1993 land was unequally divided. In 2008 father expired his share to be taken by sons who have got less share earlier but in spite of that share of all is unequal and every wants to make it equal which document to be prepared so that brother who has more share they will able to tranfer to another who have less share

File partition suit in civil court to get equal share by court order.

Is it necessary to file suit in spite all are ready to share equally?

Then go for registered partition deed.

Execute a family settlement deed and get the same registered before sub registrar office.

A Family settlement would do. If you go for family settlement in writing, show it that it is memorandum of settlement which had already been reached verbally. It is being written so that there is no dispute. This way you don't have to pay any court fee and registration is not required. if need be you can go for a declaratory suit to get it confirmed from the court.
