(Querist) 17 November 2017 This query is : Resolved 
Dear Sir,
X great grandfather . and Y grandfather of S. X purchased a property in the name of his son Y. Y1&Y2. are sons of Y. S is the son of Y1. X abd Y died. Now can S seeks Partions from the property in the name of Y.
Please advise me.

This is un-partitioned ancestral property of which S being a copacener and member of the joint Hindu family can ask for partition.

Property is in the name of Y. After Y legal heirs of Y would inherit the property. Legal heirs of Y1 (brother of Y) have no claim on the property,.

No,S can not ask for partition of property belongs to Y.property does not comes under the perview of ancestral property moreover during the lifetime of y1, s can not claim partition of property belongs to y.

S can ask for partition as it is joint Hindu coparcenary ancestral property in which as of right S can claim partition. IF he is a major he can demand partition.
