Parking Space in a Newly Constructed Building

(Querist) 04 March 2008 This query is : Resolved
I would like to know the Law related to open parking allotment to the flat owners in a newly constructed Building and now formed Co-operative society. Is it Compulsory for the builder to allot one parking per flat.
Manish Singh (Expert) 05 March 2008
you will have to go through the city's regulatory & dev. authorities rules for the same.
no, its not compulsary for a builder to allot one parking per flat but thaere should be ample parking space on the basis of which , the builder gets his plan approved from the Dev. Authority.

Most builders today do ensure that every apartment is allotted and sold at least one car parking space. However, every purchaser of an apartment should ensure that the car parking space is allotted and sold to him by the builder and:

a) that the car parking space is clearly depicted in the plan sanction

b) that the space is clearly earmarked by painting or displaying the apartment number either on the pillar adjacent to the car park or on the adjoining wall as the case may be.

c) that the space is clearly shaded and enclosed as an annexure to the agreement for sale, construction agreement and the final deed of sale.

d) that there is a clear mention in the agreements and the deed of sale relating to the apartment that the car parking space as depicted in the sketch enclosed as an annexure to the document has been allotted and sold to the purchaser concerned.

It is to be noted that as regards the open car parking which is normally provided for in the set-backs around the building, the number of the apartment for whom the car parking has been allotted and sold should be clearly displayed on the compound wall lying adjacent to the car parking slot.
