Order vii rule 1 - execution petition

KISHAN DUTT KALASKAR (Expert) 18 August 2018
Dear Madam,

My answers are as follows:
If I wait another 4 years, and if he deny the maintanance after 4 years, Can I file EXECUTION PETITION?
Ans: You are entitled to claim arrears of maintenance of last 12 or 36 months only depending upon the nature of petition your filed.

Because by the time 6 years would have been passed after the maintenance order is passed?
Ans: Now itself you file execution petition and get arrears.

Will my EXECUTION PETITION be eligible after 6 years?
Ans: Eligible to file execution petition but limited to arrears as stated above.

It is not wise on your part to delay execution of decree and any delay in this regard may adversely affect your chance for execution.
