Not seving summons to govt.officer

Mr.XYZ has lodged complaint against ABC.Now the court issue summons to XYZ for his attendance in court.He has been asked to remain present in court for five times.But the summons was not issued to him ,he remained absent.Summons firstly asked to be served by local police.But it was not served.Then it was addressed to S.P.,again not served.Then court asked to local police station to hand over summons personally.Again not served.What should be next ?? step to issue summons? No reports available ,why it was not served!

If the Government officer is not responding to ordinary summons the court may issue bailable summons without a warrant still he doesn' t appear in court my issue non bailable arrest warrant to forcibly bring him to court. No sir.The problem is that he is not getting summons.The police is not doing it's job.

IT MEANS GOVT. SERVANT HAS LODGED COMPLAINT AGAINST YOU.
1) PLEASE CLARIFY ABOVE.
2. WHAT HAS THE HON. COURT BEEN INFORMED ON THE LAST DATE OF HEARING BY THE CONCERNED PERSON/AUTHORITY, WHO WAS TO DELIVER SUMMONS.

The fact is that you are not clear in your information.
The question arises, what type of complaint the Government servant has lodged against you and whether privately or in official capacity?
Unless you give clear description about the background of the problem, you should not expect appropriate solution to your problem.

The complaint is not private. He has lodged in his powers. As he is now transferred to Dhule , a quiet long distance from the place where he has lodged complaint. Police are nor serving summons.I donor know the cause. In last hearing, Hon. Court has asked wheather complainant is present or not. As he was absent ,hon. Court has given next date for hearing. I donot know what will happen on that day. No summons was asked to draw.

Your description makes it clear that yours is an academic query, as in real case your lawyer could have understood, through whom the summons would have been served to the Govt. official.
Also, you have avoided to reply, what type of complaint the Government servant has lodged against you in official capacity?
If a real case, ask your lawyer to act correctly to get the summons issued through the competent authority.

Actually the experts of this forum respond to the questions with facts.
You are never likely to get proper reply to the riddles.
You have not stated what is the case.
It appears that summons have not been served. In that case the court may not feel justified to issue warrants.
Non-service of summons is primarily due to deep connivance of the police and in that case even the warrants are not served.

The Civil surgeon has lodged complaint against me in court regarding not taking permission for Medical termination of pregnancy.Now the hon court calls me on regular interval to attend the proceedings.As a complainant ,the civil surgeon who is about 500 km from my place ,was asked to attend the proceeding of the court.But as he is not getting summons,he is unable to attend.I have appinted lawayer,but he also do not know.
