Non reponsibility from any wrrong mc decision

(Querist) 13 February 2016 This query is : Resolved
Hello Sir,

I am residing in CHS at Mumbai.

All MC Committee responsible for good/loss to society & for taking any decision.

I want to know how MC member can safe or make non-responsible himself if he doesn't agree with resolution or decision taken which can be harmful or might illegal for society ?

MC takes decision but some MC member dont agree then what is remedy available with him (keeping part of MC) to safe himself from such wrong decision.
MC doesnt make note of disagree point in resolution. Then why person be responsible for which he was not agreed.

Thanks in advance.

If one member does not agree, his objections not taken in minutes, he should sign the minutes under protest and send his disagreeing in writing to MC under acknowledgement.

Thanks for valuable guidance Balakrishnan Sir & Goyal Sir.
Once one MC member send s disagreeing letter so that he will not be responsible for that particular matter.
1) Can this letter be send for old decisions ? & in case he may or may not have attended meeting ?
2) Can this letter be send in case of wrong selection of one other MC member (who is not member or associate member but still continues in post)
3) Disagreeing letter address to MC committee is enough ?(if not send to Dy.Registrar)

Thanks

Any letter will have no relevance, if not formally dissented on moving of a particular resolution. Once a resolution is passed by a majority vote the body of the mc, as a whole, becomes responsible, unless specifically dissented by any member, and has to implement that in principle. Any letter after passage of the resolution, if not dissented, can be considered as afterthought and shirking from responsibility.
