Non payment of salary

Sir/Madam,
The company i have been working for has failed to provide us with salary for the month of November'16 till Jan'17.. There have been numerous verbal commitments and dates given for the backlog to be cleared, however nothing has happened. Written communications have also been sent to the HR marking the senior management as well but all in vain...
Please advice what should be my next course of action.

What is this establishment; Commercial, Industrial?

What is its nature of business say; IT?

How many persons are employed in it?

What is your designation and nature of duties?

How many persons report to you?

Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state?

Since how many months you are working?
Is your employment confirmed or are you under Probation Period?

What is your monthly salary and break up?
Are all affected employees united and member of employee's/trade unions?
Has employer been issuing salary slips of each month, Form16, PF number PF a/c slips, ESIC card?

Have you resigned?

You issue a legal notice to the company for payment of salary for December and January including backlogs marking a copy to top brass. IN case they don't pay up approach Labour court for all your dues.You can expect Justice there.
