Non acceptance of resignation in central govt job

(Querist) 27 November 2015 This query is : Resolved
Respected Sir/Madam
I am a postal assistant in deptt of posts with 4.5 years of service. I have received no confirmation letter from my office so i dont know whether i will come under temporary or permanent service rules.I got selected in central excise as inspector so i applied for non technical resignation as i have not informed about the same to my department. I served one month's notice and now i am on medical , it has been more than 2.5 months and no action has been taken so far. They are not replying me but i am sending reminders continuously but no action has been taken by them. what should i do now and what will be the consequences if they will not accept my resignation. can it cause any problem in my joining of central excise.

You have jumped gun presuming so many things. You should have submitted technical resignation. There is no rule or principle that technical resignation should not accepted just because the employee has not applied for the new job without taking the serving Office into confidence.

Alternately, you do not want the benefit of present service, you may submit resignation under the provisions of Rule 5 of CCS (Temporary Service) Rules.

Thankyou very much sir.
Actually sir i have mentioned notice term in my notice period which is according to rule 5 of CCS( Temporary Service) rules. After one month the resignation is considered to be accepted in this case but how can i get relieving order from my department? what can i do if they dont relieve me .
Sir with due respect , please correct me where i am wrong and advise me the exact procedure.

You may join the new post. Generally, in a Government Organisation, relieving letter is not required to be produced.
