(Querist) 21 November 2014 This query is : Resolved
hi every one,
i am staying on rent in a hsg soc in mumbai.paying regular rent to the owner. the owner pays a non occupancy charge to the society.
i have one car and two bikes of my own.i am staying for last two years. now the society says that the flat owners can park any number of vehicle but the tenente or rented person can not park more than one vehicle althogh they are taking non occupancy charge. and all the parkings are open parking , no slit parking.
plz advice me can the society do such descrimination between the owners and renters or tenent on rent.
plz advice me.

Yes, if the byelaws of it so prescribes.

Sir,

If a decision, "not to allow parking space to the tenants of the members", is taken at the AGM, then it is binding.

However, you can ask your landlord, the owner of the flat, to consider your request favourably and ask the Society to allow you to park your vehicles if there is enough space. The decision rests with the Society.

Good Luck,

a tenant is only nominal member of society . society can refuse to give you parking slot

Alternately you can ask the owner to take up the issue with the society, if bye laws relax, you may get chance.
