Ni act cases

sir mene 138 ni act ka notice 07/02/014 ko aqused ko diya or unservreturn notice 17/2/14 ko prapt kiya or mene ni court me case 28/2/14 ko file kr diya. court ka kahna hia ki mera kesa premature h or mera khna h ki notice dene se 15 din ka time start ho jata h so mera case premature nhi h.
plz suggest me sume supra cases wher they admit date cause of action notice sent karne se start ho jata hai.

Court is very right.your case is actually premature.complaint can be filed after lapse of 15 days period from the receipt of notice and not from the date of sending notice.

What is the meaning of a statutory notice in NI Act?Get it clarified from UR lawyer.

JO KUCH BHI HO AAPKA COMPLAINT ADMISSION STAGE MEHI MAINTENABLE NAHI HAI.
When U mention that the accused has to repay the cheque amount within 15 days from the date of receipt of this notice U have to abide by it.Here whether the accused has received the notice or not is immaterial.How could UR lawyer ignore technicalities.
