Neighbour has kept earthern pots on balcony walls without protection

(Querist) 23 May 2015 This query is : Resolved
I live in a co-operative group housing society. Few of our neighbours have kept earthen pots (Gamla's) on the top of the walls of their balconies. These walls are barely 5 inch thick. There is no protection around them either. Some of them stay on the 5th floor. They are clearly a danger to everyone as they can easily fall and injure someone - possibly may also cause death. In the past once one such pot had fallen from above and it was plain luck that no one came under it.

A request to them to remove these pots has fallen on deaf ears.

What is the remedy in law.

@Mr.Sudhirkumar ji - What is meant by "thana"?
Sudhir Kumar, Advocate (Expert) 24 May 2015
give a complaint in Thana. If police does not take action then give application to SDM seeking exercise of his powers u/s 133 Cr PC for abatement of nuisance.

Did you discuss the issue with the member/ resident? What is the problem in non-removal of the gamlas?
Did you seek help from Managing Committee? What is their response?
The balcony is forming part of "common area" which cannot be used in such a way.

Before going into legal process try to amicably settle the matter by putting it before society meeting
Sudhir Kumar, Advocate (Expert) 25 May 2015
you can try amicable solution.

It can be expected that when a person is so stupid to keep flower pot at such height without safety then he will be obstinate enough not to remove the same.

@ Mr Jagagrao

All Police stations in South Asia are called Thana.
