Need to pay stamp duty of the first owner in a had a mhada f

(Querist) 27 February 2017 This query is : Resolved
Stamp duty was not paid by the first Owner on a Mhada flat. Can someone please tell me what is the procedure and how shall I go about it. The flat is in my name and I am the 3rd owner..thanks

Sir,
If the legally levied stamp duty is not paid the flat will not be registered to your name. It is imperative that the document to the ownership of the flat is properly stamped and registered for an absolute claim of ownership.
Good luck,

Take help of local lawyer, get all the records scrutinized and proceed as advised by the department.

Normally, the document shall not be released without payment of full stamp duty. But in some cases, pending a any procedures/ decision, documents can be released by Registrar with deficit stamp duty on a condition that the party has to oblige the decision.

In such a case, you may have to pay the deficit duty and the remedy available to you is to collect the amount from the first owner.
