Mutual divorce procedure

Hi,

We have been in a mutual separation for the past 5 years now, of course after an eight long years of rough married life. My husband and I have never attempted to communicate in any means in the past years. I would like to take this legally done and closed. I have a 12 year old girl child.

I have a well settled career, and I do not expect any obligation from other end. please let me know how to go about this?
and let me know how long will this procedure take?

It should maximum two years if both of you file a Mutual Consent petition for divorce.

Firstly, you can issue a notice to your husband seeking divorce by mutual consent. If he agrees, then both of you can jointly file a petition before the Family Court. The petition will thereafter be posted after 6 months. If both of you do not patch up, court will grant divorce. So far as custody and maintenance are concerned those things can be sorted out amicably.

Finalization generally takes six months after filing of a joint petition for Mutual Consent divorce.

Get enquiries about the intention of your husband first and then chalk out your stretagy. If he is ready for mutual divorce petition then it is ok otherwise file divorce on the ground of desertion .
