Mpid related

(Querist) 27 February 2015 This query is : Resolved
DEAR SIR.
I purchased a plot from company. After 3 months of my transaction that company is charged MPID. And we purchased this plot by giving Bank DD. But after few days back we receive a letter from Police to pot to resent all the doc. of property. I showed all original. They take my statement along with photocopy. After after that they issue me notice not to sell the plot till we complete the investigation. After this they also notice to Registat Office not to register the property as the company is charged MPID. Now how can we release the same ? Is this property they attach by law ? This transaction is completely Bonafide.

Police has no jurisdiction in the matter. Disposing one's property is a natural right and it caanot be interfered except by the due process of law.

Sir..thanks..but I register a compliment to collector against this. Collector also told that all doc send to govt. And this property can be attached after the notification from govt. So kindly suggest what to do next. Also can we put the case to high court Nagpur. And also suggest the Advo if possible. Collector not given any letter that not to sell.

You can challenge the notice of police for not to sell the plot. For lawyer search LCI database.

You will have to wait till the investigation is completed. Even if you wish to sell the plot, there will not be any takers at this moment. Since the seller of the property is involved in fraud, the police can take these steps during investigation. Wait and see. whether the notice by police is legal or illegal is not the question for the present. If you wish to prove that the notice is bad in law, you will have to contest. Contesting police investing good money for bad money (legal expenses) is not necessary at this stage. Don't be in a hurry. Like you there might be some other people.

The experts have advised well. Since the property is involved in fraudulent transactions, the investigation authorities have the right to issue such notice, you can either contest the notice in the court or wait for the outcome of the investigation.
