Mothers property

Dear Sir,

We are 3 brothers to our parents.

My Father and Mother both are alive.

There is one house in my mothers name.

She wanted to make a will in name of eldest son.

Can she make a will in name of eldest son, is this in accordance with law.

Can the other two sons sue for their share in property.

Kindly advice.

Also advice what will be the consequeces if no will is executed by my mother.

If no will is there after the demise of the property owner the Legal Heirs could claim equal share

If is self acquired property and not ancestral the owner has the full right to decide and dispose it as per her/his choice/wish

Being a sole owner of house , your mother has right to bequeath the house as per her wish , No body can legally challenge her wish.

If mother is sole owner/title holder of the property he can dispose the property in her name in her life time in anyone's favor by a valid/registered deed e.g; WILL.


She does not need anyone's consent for IT.

In case succession of Hindu woman the nature and source of property matters.


A Hindu woman that dies without disposing her estate/property that is self acquired, in her life time by a valid/registered deed and/or leaving a valid WILL;
The 1st right for equal share is of husband (if alive as on date of death), sons, daughters.................

Usually parents do not discriminate.

Request the mother to dispose equally amongst all sons/daughters or not to leave a (valid) WILL.

She may agree.

Your mother may execute a will in favour of either of you or any one else if it is her self=acquired property.
Rest of the world cannot have any objection, if any one objects it would not sustain.
