Money extortion from uncle

Hi Team,

My situation is a below,

My uncle is trying to extort money from my father. A property was sold, in which we distributed money among each other, but he tried extorting us while we were at the place, and framed us in a fraud case of hitting a dalit, and then asked us in return for 30 laks, 10 of which we paid in cash, rest we said will arrange. Now he is sending threats about doing more.

What legal measures should we take? If anyone could help out, it would be really helpful

File a complaint with Police and pusue action

Why did you pay any amount? You should have straightaway approached the police.

Thank you for your reply Isaac and Kishor sir, really appreciate it. We had to pay the amount because he held us as in a fraud case by involving a dalit person, saying we had abused him when we had no contact at all. We know it was a mistake but want to take action. Is there any particular sort of complaint that I should address or a general police complaint? I am scared he might get abusive and take physical action, and damage our properties. Could you please suggest any preventive measures? Should we inform a lawyer along with police?

Collect all the evidences including call records of threat.
File a complaint against the said uncle at the nearest police station.
If the Police refuses to take action or to file FIR, directly file private complaint at the Magistrate court.

file complaint with the police and or approach to the Learned Judicial Magistrate, with your complaint. consult the Learned Advocate of your locale jurisdiction for proper guidance in terms of the Law to get relief.
