Matrimonial

(Querist) 21 August 2014 This query is : Resolved
Dear Sir,
My friend's wife has walked out from her matrimonial house to a separate rented flat and insisting her husband to stay with him & she will pay the rental & agreement is on her name. She is not objecting him to support his parents. earlier, my friend has refused to move out of his parents place since he could not maintain two families at different place due to financial constraints.

Kindly provide a draft MOU since his wife is moody, abusive (bipolar) & argumentative. It is due to her & her parents pressure my friend is agreed, as the said rental place is a few blocks away from his parental home. she has promised that if non compatibility problem arises still both has decided to under go MCD. even though it may or may not help in case they decided to go for divorce, but something is always better in writing.

Pl help us in this regard with a draft & advise. As my friend does not want to loose his parents place as his matrimonial status as he is the only son staying & taking care of his parents.

Thanks
Best Regards
SN

Agreed with expert Shri Sudhir Kumar. We can not supply the specimens and drafting of agreements. We can only suggest the steps to be taken analysing the contents posted by the author.

At the same time, marriage is a mutual trust. If there is no trust or breach of trust, no MOUs will work. Hence tackle the delicate situation in a different way. I too support initially if the boy's parents themselves are forcing him to go to a separate house, better he join with her for some time and observe her behaviour. He should maintain calm and cool. But this is only a temporary solution. Once you start yielding to the power tactics she goes on playing the same on you for some other matter also. Be tactful and slowly counsel her reminding her duties towards your family.

Dear Learned councils,

Many thanks for yr quick response. we are grateful for yr advise. pl note that we did not mean a full fledged MOU but basically the points in order to cover in MOU depending on the Brief given on the matter. Yes in our statement this might have construed as MOU draft, agreed which can not be done without privy to all the facts.

Thanks
Best Regards

In this instant case, no kind of MoU can safeguard you. Move ahead if you have trust.

Advised properly by all experts, consult a local lawyer and get the desired MOU drafted as per your taste and situation.

Faith, Confidence, and Love these three are the main pillars of marital life. Look at your parents, how many MOU were signed by your father and mother? Without any MOU how they are maintaining their lives as husband and wife together? In married life proper understanding , mutual adjustment and giving up ego are the main criteria. Follow it properly to maintain a happy married life.TRY TO GIVE RECOGNITION TO YOUR WIFE. Because in present era girls are educated and brought up with the same status like boys so the sense of 'SELF' among girls are very strong, try to recognize their SELF.

I fully agreed with the advice of Ld.Expert shri Biswanath Roy.
