Hello evryone....i need to know about how to get a cancelation of a marrige certificate.I was married but got divorced.while the divorce was in the court i was suggested to get married again and register the marrige after getting the divorce degree.i did so. I got married to my present wife and we registered the marrige after getting divorce from my ex wife.and then i applied family visa for my wife but it got rejected and the reason they gave was as expected.they said that the marrige certificate is not valid as i was not divorced yet while getting married to my prsent wife.so i consulted a few people and almost all of them suggested me to get ritually married again and register the marrige now bcoz it will be legal as i already got divorced.i did the same.the only difference was the firdt one was made by nagar nigam but the second one was made by the court in the collectors office.now i applied the visa again with the nrw certificate but they rejected it again saying how is it possible to get a new certificate while having one.so i need to tell them that i m getting cancelled the first one which was made by a mistake and anyways it was not valid.please suggest me what kind of documents can i get to prove that only the second certificate is valid or how can i get the first one cancelled

You go to Sub registrar office and get the earlier marriage certificate cancelled and let him put a stamp of approval on the second valid marriage certificate. Also carry your notarized affidavit as to why your earlier marriage certificate got cancelled and in its place why a new marrige certificate had been issued.

Normally there is No Procedures in Registrar Office like Cancellation of marriage. Only the Court orders of Divorce would legally Suffice.

Marriage with out Divorce is invalid and Pass Port Officials are right and you should be happy that you were not implemented with any legal action or criminal proceedings. by them.

Discuss with local advocate or Passport agents near concerned passport office and initiate fresh action for deleting the first wife in passport basing on Court Divorce Orders and including the New Wife Complying the Formalities.

You have posted facts burdened with personal opinions. Please post the simple facts. By the way, which 'court in the collector's office' has registered marriage and issued the certificate. It appears that either you have been misguided or you are less than honest with the facts.

1. You have already been misguided by some non-legal persons to get married even before you were granted decree of divorce. Subsequently you were again misguided to submit your passport papers on the basis of second marriage which is void and illegal during subsistence of your marriage.
2. Later on you got some good advisor and you got again re-married before the Registrar of Marriages.
3. Now again you HaVe beEn misguided by an impersonating expert to approach Sub-Registrar for getting the marriage certificate cancelled by putting a stamp of validity of second marriage. However, never rely upon the advise of so-called (but impersonating) EXPERT(s) despite the fact it is available FREE OF COST.
4. God is great to save you from your advisors and impersonating experts, wherein I do not have any comments to your previous action, conduct and approach.

If you are really divorced, you can get divorce order from the Court.
That order itself is sufficient. No order is issued by Sub Registrar or Collector.
Consult a good local lawyer in person.

Hope you approached approach a very able senior LOCAL counsel of unshakable repute and integrity specializing in Family and having successful track record ….. and worth his/her salt …for your case(s) and opinion …
Did such counsel tender opinion to get married before divorce is granted by court and register the marriage after divorce?
There are many threads at LCI on such matters and you may find as posted by Vashistaji, advocates tendering such and even stranger advises, recklessly, that are self invented.
Such entities advertise and show off pictures of Old faces feeling that IT may add some weight......and end up losing weight.
Vashistaji must have looked into his posts in threads and posts in threads participated by Vashistaji.
At time Vashistaji might have felt and even posted that he might like to amend and IT is good.
The law of the land does not concur with self invented one that can at the most be hallucinations of entities vouching for such self inventions…
One such entity has been posting on A to Z ...........( Alph, be , pe te in Urdu) and still stuck up with self invented ones on unending subjects like say ; Divorce, Nomination and succession although the courts of law have put speculations to rest....
The scope to post such hallucinations in this thread is being avoided...
By the way you must be having forms submitted for registration of marriage.

What is submitted in the form by you both; marital status, date of marriage...

Per procedures of personal law/applicable rules/customs of community etc 2nd marriage without divorce can be invalid...
The Passport office personal must have duly updated you on reasons as well....
You need to satisfy them with legally justified logic and documents...

Inquire LOCALLY and find such counsels...................
The FREE advise posted at LCI is not WRONG barring exceptions and such exceptions are daily insatiable chronic habit for IT's and entities that scuttle fruitful and illustrated discussions
have personal allergies to illustrations, citations and Experts preferring to post illustrations, citations and openly ask to not to post illustrations, citations........
Any querist can find and prevent such entities............

May lord almighty bless you and all and grace with developed common sense to decide by common sense
and 1st approach he elders of the family, competent and experienced well wishers, successful persons that have succeeded as PIP and are well versed with matters, neutral and reputed person for advise based on common sense
and keep them by the side
and at by their wise advise
and avoid litigation as much as possible
and if need be chose LOCAL counsels as already suggested above....
and then abide by proper legal opinion...
