Married daughter can get father job .

Sir, i am shilpa 25yrs . my dad died in due to heart attack in the age of 54yrs . and i am married girl can i get my dads job. my brother and husband dont have any objection to take my dad job. . i saw news that married daughter can also gets father job by giving no objection certificate from mother ,brother and husband . i am sending news details also please go through it and suggest me . shall i apply for job or not.:.....Times of India Married daughter of a government employee is eligible for a job on compassionate grounds after the death of her father while in service, the Madras high court has ruled. But, she should fulfil two requirements, the court said. One, she must obtain no-objection certificate from other siblings; two, she and her husband must give an undertaking that she will take care of other members of her parents' family from her salary. An order to this effect was passed by a division bench of Justice Satish K Agnihotri and Justice M Venugopal recently, while dealing with a case of I Kayalvizhi whose father V Indarjith died while in service in the education department. "A married daughter is eligible for consideration, subject to submission of no-objection certificate of other members of the deceased's family and also with an undertaking from her and her husband that she will take care of other members of the parents' family," the bench said

Dependent daughter can get the job.


As per the judgment quoted by you married daughter can get the job subject to conditions in judgment.


So ideally the employer should not object.

Approach the competent authority and download the requisite procedure and discuss and obtain their concurrence and submit the claim.



However minute the discussions and draft the covering letter carefully and submit under proper acknowledgment.

Bombay High Court decision can be quoted as passing reference in Karnataka, through your lawyer.
Compensatory appointment can not be claimed as a right. More over, after marriage you are not dependent on your parents.
Consult a local lawyer practicing in service matters.

You are mistaken. First right goes to your mother and thereafter only on an eldest unemployed member of the family if the whole family has to depend upon him/her for their livelihood. High court decision of mumbai may not help you, as the employer is not bound to act upon the judgment in another's case, unless court orders the employer in your personal case after trial on merits of the case.

Have you inquired in office of the authority or met the authority at all.


If mother and brother agree to sign NOC/Disclaimer etc then authority may agree.
