Maintenance revision appeal - since last 2½ years

(Querist) 16 April 2014 This query is : Resolved
Dear Experts,

The judgement on DVC ordered me to pay monthly maintenance to my children which I am paying regularly.

However, my lawyer advice me to appeal for the reduction in maintenance and I agreed. Since last 2½ years the appeal is in the court. Both parties argument were recorded but till now no judgement passed.

Could you please advice:
1. what are the reason for taking such long period to conclude?
2. How can I request my lawyer/court to faster the proceedings.
3. can she file revision for maintenance once order passed for my appeal.

Thanks in advance.

Without knowing the case status on each dates, it is difficult to presume.
Delay may occur-
1. due to reluctance to fast track case by lawyers.
2. same thing by judge
3. vacancy of posting of judge in the concerned court etc.

Yes she can challenge the order passed in appeal court.

Thanks indeed Barmanji for your prompt response. Appreciated.

I am just wondering if there is any time bound period (limit) to close the appeal?
Devajyoti Barman (Expert) 16 April 2014
no , there is not unless high court passes such direction in specific cases only.

There is no time bound to close the appeal in time.
ajay sethi (Expert) 17 April 2014
when were arguments completed? ordinarily judgement has to be pronounced within period of 3 months from completion of arguments
T. Kalaiselvan, Advocate (Expert) 17 April 2014
agreed, the delay on judgement on appeal will depend on the prevailing situation of the court where there are many factors to be considered.
